SF dim sum restaurant reopens at new spot following lawsuit

City View Restaurant has reopened at a new San Francisco outpost.

The decades-old dim sum restaurant has settled into the ground floor of 33 Walter U. Lum Place after closing its former outpost at 662 Commercial St. late last month, according to its business website. The move comes months after City View Restaurant’s former landlord, Chinatown Community Development Center, filed a lawsuit against the business.

In January, SFGATE reported that City View Restaurant’s lease ended in October 2022 but remained on-site for the next several months. Chinatown Community Development Center subsequently filed an unlawful detainer lawsuit on Jan. 12 when City View Restaurant remained on-site after it was denied an extended lease.  

Days after SFGATE published the story, Chinatown Community Development Center told SFGATE that it couldn’t extend City View Restaurant’s contract due to structural improvements and safety updates required on the building.



“Despite repeated and protracted attempts, we were unable to reach an agreement with City View to give contractors access to their ground floor space to start and complete those upgrades,” Chinatown Community Development Center said in a statement. “Therefore, we planned to start the upgrades after the end of City View’s lease.”

In a separate lawsuit, the Cantonese restaurant stated that it continued to pay rent after October 2022 and alleged that Chinatown Community Development Center accepted its payments. Chinatown Community Development Center denied the allegation and told SFGATE that it had never cashed the checks and instead returned them to the business.

What Now San Francisco first reported that City View Restaurant had its eyes set on 33 Walter U. Lum Place before the lawsuits took place. San Francisco Planning records show that the restaurant filed a planning application in 2021 to debut at the same building that once housed the historic Empress of China restaurant.
