Delhi mayoral polls: Nominated members can’t vote, says CJI

The polls to elect the mayor and deputy mayor of Delhi will not be held till February 17. An assurance to this effect was given by the Lieutenant Governor (LG) of Delhi V K Saxena to the Supreme Court which on February 17 will take up the plea filed by the Aam Aadmi Party (AAP) challenging the manner in which the elections are slated to be held.

The top court verbally observed that nominated members cannot vote in the mayoral elections. Speaking for the bench comprising Chief Justice of India (CJI) DY Chandrachud and Justices PS Narasimha and JB Pardiwala, the CJI said that it is very clear that nominated members cannot vote.

Appearing on behalf of the AAP, senior Advocate Abhishek Manu Singhvi told the Bench that on Sunday a communication was received from Delhi LG VK Saxena stating the polls would be held on February 16.

However Additional Solicitor General (ASG) Sanjay Jain, appearing for the LG, assured the Bench that the polling could be deferred till the top court hears the matter considering the time constraint on Monday.

The development took place during the resumed hearing of a petition filed by AAP’s mayoral candidate Shelly Oberoi who has also sought early conduct of the mayoral election. The election has been deferred three times so far.

The plea has also objected to holding simultaneous elections to the post of mayor, deputy mayor and standing committee.
